Cascador Terms of Use

These Terms of Use (together with the Privacy Policy and all documents referred to in them) (“Terms”) govern your access to and use of the Cascador website and any related platforms, tools, content, events, or services made available by Cascador and its affiliates (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with or accept any of these Terms, you should stop using the website or Services immediately.
- Definitions
“Cascador,” “we,” “us,” and “our” mean Cascador and its affiliates. References to us in these Terms also includes any group companies which we may have from time to time;
“Cascador Content” means Content that we create or make available through the Services;
“Content” means any text, documents, spreadsheets, pitch decks, images, photographs, video, audio or other multimedia content, code, data, software or other information or material submitted to or on the Site;
“Events” means community events, fireside chats, Demo Days, mentor/advisor sessions, workshops, interviews, or other programme activities, whether public or private, hosted, operated, or coordinated by Cascador (or in collaboration with others);
“Intellectual property rights” means rights such as copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world);
“Privacy policy” means the policy which governs how we process any personal data collected from you;
“Site” means Cascador website and related or associates pages and subdomains;
“Terms” means these Terms of Use as updated from time to time;
“you” and “your” mean you as an individual user of the Services (including founders, applicants, advisors, mentors, investors, partners, sponsors, alumni, or other community members), and, where applicable, the organisation you represent;
“Your Content” means Content you submit or provide through the Services (including applications and supporting materials).
- Changes to These Terms
Cascador may update or modify these Terms of Use from time to time. When we make changes, we will post the updated Terms on this page and revise the “Last updated” date at the top of the Terms. Where appropriate, we may also provide notice of material changes through the website, by email, or through other reasonable means.
Unless otherwise stated, changes to these Terms will take effect no earlier than seven (7) days after they are posted. Changes that relate to new features or services, or that are required to comply with legal or regulatory requirements, may take effect immediately.
Your continued use of the Services after updated Terms take effect means that the revised Terms will apply to your use of the Services going forward.
Certain features (such as applications, events, programmes, or funding processes) may be subject to additional terms, policies, or guidelines presented in connection with those features. If there is a conflict, the additional terms govern that feature.
- Eligibility
The Services are intended for use by individuals who are legally able to enter into binding agreements under applicable law. By using the Services, you represent that you meet this requirement. You agree to use the Services lawfully and not to misuse, disrupt, or attempt to gain unauthorised access to the Services, systems, or data. Cascador may modify, suspend, or discontinue any part of the Services at any time.
- Use of the Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
- use the Services in any way that violates applicable laws or regulations;
- interfere with or disrupt the operation, security, or integrity of the Services;
- attempt to gain unauthorised access to any systems or data;
- submit false, misleading, or fraudulent information;
- use the Services to infringe the rights of others.
Cascador may suspend or restrict access to the Services at any time if it reasonably believes these Terms have been violated.
- Accounts, Applications and Participation
Some parts or features of the Services may require you to create an account or submit information (including applications). You agree that:
- information you provide is accurate and not misleading;
- you will keep login details secure (if applicable); and
- you are responsible for activity under your account.
Submitting an application or participating in the Services does not guarantee acceptance into any programme, selection, funding, partnership, or other opportunity or event. Cascador may evaluate applications and participation in its sole discretion and is not required to provide feedback. Cascador retains full discretion over selection, participation, and programme structure.
Cascador may modify, suspend, or discontinue any programme, event, or opportunity at any time.
- Intellectual Property and Application Materials
The website and Cascador content are owned by or licensed to Cascador and are protected by Intellectual Property Rights. You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit Cascador Content except as permitted by law or with our written consent. Trade marks, logos, and branding displayed on the website are owned by Cascador or third parties. You may not use them without permission.
You retain ownership of any intellectual property rights in materials you submit to Cascador, including application materials. You are responsible for Your Content and for ensuring you have the right to submit it. However, by submitting materials through the Services, you grant Cascador a non-exclusive, royalty-free licence to use, review, host, analyse, reproduce, and share (with reviewers and partners as described below)such materials as reasonably necessary for application review, programme delivery, due diligence, funding activities, and related purposes.
Cascador receives a large number of applications and works with founders across many industries. You acknowledge that Cascador and its staff, advisors, mentors, partners, and affiliates may work with or support other companies or ideas that are similar to those described in your application.
Cascador does not undertake to treat application materials as confidential for the purpose of protecting general ideas, concepts, methods, or information that is publicly known or commonly used in an industry. You should carefully consider the nature and level of detail you choose to include in application materials. Cascador does not request or require applicants to disclose trade secrets as part of the application process.
Nothing in these Terms restricts Cascador from independently developing, supporting, or funding businesses that may be similar to those described in your application, provided Cascador does not intentionally misuse your personal information.
- Feedback and Suggestions
If you submit ideas, suggestions, or feedback (“Feedback”), you agree that:
- Feedback is provided voluntarily and does not contain confidential or proprietary information of third parties; and
- Cascador may use Feedback without obligation to you.
You grant Cascador a non-exclusive, worldwide, royalty-free, perpetual licence to use, modify, publish, and incorporate Feedback into the Services or Cascador activities.
- Events, Recordings, and Publicity Acknowledgment
Cascador may record, photograph, or otherwise capture audio/visual materials at Events (“Event Recordings”). By attending or participating in an Event, you acknowledge and agree that:
- you may be recorded or photographed;
- Event Recordings may include your name, image, voice, likeness, or other identifying information; and
- Cascador may use, reproduce, and share Event Recordings (including on Cascador’s website and social media channels) for purposes related to documenting, delivering, and promoting Cascador’s programmes and activities, without additional notice or compensation, except where required by applicable law.
- Content and Educational Materials
All content made available through the Services, including text, graphics, videos, courses, blog posts, and other materials (“Content”), is owned by or licensed to Cascador and is protected by applicable intellectual property laws.
You may access and use Content for personal, non-commercial purposes only, unless otherwise agreed in writing. You may not copy, distribute, modify, or exploit Content without Cascador’s prior written consent.
- Introductions and Third-Party Relationships
As part of its support for founders, Cascador may facilitate introductions to third parties, including advisors, investors, partners, lenders, banks, or other organisations. Cascador does not guarantee the outcome of any introduction and is not responsible for the conduct, decisions, terms, outcomes, or actions of third parties.
Any relationship entered into following an introduction is solely between you and the relevant third party. Any engagement with third parties is at your discretion and subject to their terms and policies.
- Prohibited Conduct
You agree not to (and not to help others):
- violate laws or third-party rights (including IP, privacy, or confidentiality);
- misuse the Services or interfere with their operation;
- probe, scan, or test the vulnerability of the Site or breach any security or authentication measures;
- impersonate others or misrepresent your identity or affiliation;
- submit false, misleading, defamatory, unlawful or infringing content;
- attempt to gain unauthorised access to systems or data;
- use the Services to send spam or bulk unsolicited communications;
- upload malware or attempt to disrupt or reverse engineer the Services;
- use the Services to violate applicable laws or the rights of others; or
- scrape, harvest, mine copy, or exploit the Services, personal information of others or content without permission.
The website may be accessed globally. If you access the Site from outside the country where Cascador operates, you are responsible for complying with any local laws that apply to you. We may suspend or restrict access to the Site if we reasonably believe you have breached these Terms or created legal, security, or operational risk.
- Funding and Investments
Where Cascador provides funding or financial support, such support will be governed by separate written agreements. These Terms do not create any obligation on Cascador to provide funding, nor do they replace or modify any investment or financing documents.
- Educational Content and No Advice
Any educational resources, courses, blog posts, or materials provided through the website or Services are for informational purposes only and do not constitute legal, financial, investment, tax, or professional advice. You should obtain independent advice before making decisions.
- Disclaimer of Warranties
The Services and Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Cascador disclaims all warranties, whether express or implied, including warranties of accuracy, reliability, security, completeness, fitness for a particular purpose, and non-infringement. Cascador does not guarantee outcomes, including acceptance into programmes, funding, introductions, partnerships, business success, or specific results.
The website and Content are provided for general informational purposes only. We try to keep information accurate and up to date, however, Cascador does not guarantee that the Services will be uninterrupted, error-free, or secure. Any reliance you place on Content is at your own discretion and risk. We may suspend, discontinue, or change the website at any time. We do not guarantee uninterrupted availability of the website.
- Limitation of Liability
To the fullest extent permitted by law, Cascador shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising out of or relating to your use of the Services, including loss of profits,goodwill, data, or business opportunities.
Cascador’s total liability for any claim arising under these Terms shall not exceed the amount (if any) paid by you to Cascador for the relevant Services in the 30days prior to the event giving rise to the claim, or USD $100 (or local equivalent).
- Indemnification
You agree to indemnify and hold harmless Cascador and its affiliates, officers, employees, advisors, and partners from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to:
- your use of the Services,
- your content,
- your violation of these Terms, or
- your violation of any rights of another person or entity.
- Sanctions and Compliance
You represent that you are not located in, organised under the laws of, or ordinarily resident in a jurisdiction subject to applicable sanctions or embargoes, and that you are not on any list of prohibited or restricted persons maintained under applicable sanctions regimes. Cascador may restrict access to the Services as needed to comply with applicable law.
- Third-Party Links
The Services may contain links to third-party websites or services. Cascador does not control and is not responsible for the content, terms, or privacy practices of third-party sites. Access to such sites is at your own risk.
- Privacy
Cascador’s collection and use of personal information is governed by the Cascador Privacy Policy, which forms part of these Terms.
- Termination
You may stop using the Services at any time. Cascador may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms, created risk, or misused the Services.
Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnity, and governing law) will survive.
- Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria, excluding conflict-of-law rules. Any disputes will be brought in the courts located in Nigeria, unless applicable law provides otherwise.
